APGA May Not Have A Candidate In Idemili North & South Federal Constituency, See Why

 

Hon Tony OneWeek Muonagor, the APGA aspirant for Idemili north and south federal constituency has approached the court to nullify the primary election of the party which produced Hon Ikenna Iyegbu popularly known as Ike Cubana.

TonyWeek is angry that the party contravened section 84 of the electoral act 2022 and party guidelines of APGA for the primary election for 2023 general elections.

According to section 84 subsection 5(c)(i), political parties must conduct her primary elections for senate, house of representatives and house of assembly in the constituency where it tends to sponsor a candidate.

In the case of Idemili north and south federal Constituency, APGA held her primary election at King David Hotel, Awka and not in Idemili federal constituency. AIF Media gathered that the primary which was earlier scheduled to hold in Ogidi was hijacked by the camp of Ike Cubana and taken to Awka where he was declared winner despite protests to their action.

Section 84 subsection 5(c) states thus;
In the case of nominations to the position of a senatorial candidate, a member of the house of representatives and a member of a state house of assembly, the political party shall, where it stands to sponsor candidates;

(i) hold special congresses in the senatorial district, federal Constituency and the state assembly constituency respectively, with delegates voting for aspirants of their choice in designated centers on specified dates;

Sequel to this provision of the electoral act, the APGA guidelines for the conduct of party primaries for the 2023 elections in section 33 specified conditions for the nomination of candidates for national assembly at the special congresses.

In section 33 subsection 1(b) APGA guidelines states;
House of representatives special congresses/primary election shall be held within each federal constituency at a venue designated for that purpose by the National Assembly Electoral Committee.

From the above, it is clear that there was a non compliance and total violation of both the electoral act 2022 and the party guidelines for nomination of candidates for the House of representatives in Idemili north and south federal Constituency.

Hon Tony OneWeek has a strong case to nullify the candidature of Ike Cubana in court.

The electoral act in section 84(11) stated that where a political party fails to comply with the provisions of this Act in the conduct of its primaries, its candidate for election shall not be included in the election for the particular position in issue.

With the clear violation of both the provisions of the electoral act and the APGA guidelines for the conduct of the party primaries, Ike Cubana is as good as not a candidate of APGA for 2023 general elections.

APGA has no candidate in Idemili north and south federal Constituency. That’s the position of the law.
