Ben Nwankwo Asks Court To Sack Azubogu As APGA Candidate, Case Adjourns To August 29

Yesterday, the Federal High Court Abuja started hearing on the suit no. FHC/ABJ/CS/909/2022 filed by Hon Ben Nwankwo of APGA asking the court to nullify the nomination of Hon Chris Azubogu as the candidate of APGA for 2023 Anambra south senatorial election.

When the case was mentioned, the counsel to Ben Nwankwo told the court that Hon Azubogu had even evading service and submitted an application praying the court to order for a substituted service on him.

The court granted his request and ordered that Azubogu be served through the clerk of the national assembly.

The judge therefore adjourned the case to August 29, 2022 for further hearing.

Hon Ben Nwankwo is asking the court to nullify the nomination of Hon Azubogu on the grounds that he is still a member of PDP and can not hold the ticket of APGA for Anambra north senatorial zone.

Ben Nwankwo asks the court to interpret sections 65(2)(b), 68(1)(g) and 68(2) of the constitution of the federal republic of Nigeria, section 84(1) of the electoral act 2022 and article 27(1)(f) of the APGA guidelines for 2022 for primary elections 2022.
