Nigeria’s IGP Sued for Staying in Office Beyond Retirement Date

Festus Ogun, a constitutional and human rights lawyer, has filed a lawsuit against Nigeria’s Inspector General of Police, Usman Baba, over his continuous stay in office after his retirement age.

Ogun is seeking a declaration from the court that Baba’s stay in office is illegal and unconstitutional. He also wants the police boss to refund all payments received as salaries and allowances after his retirement date.

The suit, marked FHC/AB/CS/24/23, was filed on April 20, 2023, at the Abeokuta Judicial Division of the Federal High Court. Ogun believes that the rule of law must be respected regardless of the person involved.

The suit is brought under the 1999 Constitution of the Federal Republic of Nigeria, the Police Act, 2020, and the inherent jurisdiction of the court.
