Non-Declaration of Assets May Lead to Removal from Public Office – CCB

Public officials who fail to declare their assets in accordance with the constitution may be removed from office, the Code of Conduct Bureau (CCB) has warned. The CCB stated that the President, Vice President, members of the Federal Executive Council, presidential aides, state governors and cabinet members, National Assembly and state Assembly members, and local government chairmen must declare their assets with the bureau upon taking and leaving office.

According to the CCB website, defaulters may be removed from office and also lose undeclared properties. The bureau stressed that the responsibility to collect, fill, and return asset declaration forms lies solely with the declarant.

The CCB explained that declarants must provide detailed information, including the number, types, address, value, and date of acquisition of their properties, as well as income derived from the properties where appropriate. After completing the form, the declarant must personally swear to the declaration before a high court judge nearest to their work station before submitting it to the bureau.

The CCB warned that failure to declare assets as required under the provisions of paragraph 11 of the 5th Schedule of the Federal Constitution shall attract on conviction any or all of the following: removal from office, disqualification from holding any public office, forfeiture to the state any property acquired in abuse of office or dishonesty. Incoming officials are required to submit their asset forms within three months of taking office.

The warning by the CCB has raised concerns about the level of compliance by public officials with asset declaration requirements. The bureau has called on all public officials to comply with the constitutional provisions in order to avoid any legal or reputational consequences.
